TrueGrow AI Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the websites, software, applications, APIs, and services provided by TrueGrow AI Inc. ("TrueGrow AI," "MediaFlow," "we," "us," or "our"), including:

• https://truegrow.ai
• https://mediaflow.truegrow.ai
• MediaFlow influencer, agency, and company portals
• All related tools, features, integrations, analytics, and AI-powered services

(collectively, the "Services").

By creating an account, accessing, or using the Services, you agree to be bound by these Terms, our Privacy Policy, Data Processing Addendum (DPA), Security Statement, and Cookie Policy, which are incorporated by reference.

If you do not agree, do not use the Services.

2. Eligibility & Account Registration

You must be at least 18 years old to use the Services.

When registering, you agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

3. Account Types & Roles

MediaFlow supports multiple account types, including:

• Influencers / Creators
• Agencies / Agents
• Companies / Brands

Each account type may have access to different features, permissions, and data. You are responsible for ensuring that your use of the Services aligns with your authorized role.

4. Connected Accounts & Integrations

By connecting third-party platforms (e.g., Instagram, Facebook, Threads, TikTok, YouTube, LinkedIn, Google), you authorize MediaFlow to access data made available through official APIs, including analytics, content metadata, comments, and direct messages, as permitted by you.

You represent and warrant that you have all rights and permissions required to connect and manage any third-party account linked to your MediaFlow account.

a. Third-Party Platform Terms Compliance

Meta Platforms (Instagram, Facebook, Threads)

By connecting Instagram, Facebook, or Threads accounts to MediaFlow, you acknowledge and agree that:

• Your use of these integrations is subject to Meta's Platform Terms and Meta's Developer Policies
• You will not use data obtained through Meta APIs for surveillance, discriminatory purposes, or in ways that violate Meta's policies
• MediaFlow's access to your Meta account data may be revoked by Meta at any time if platform policies change or violations occur
• You are responsible for ensuring your use of Meta-sourced data complies with all applicable Meta policies and community guidelines

Other Platforms

Connections to other third-party platforms (TikTok, YouTube, LinkedIn, Google) are similarly subject to those platforms' respective developer terms, API policies, and usage guidelines. You agree to comply with all applicable third-party terms when using MediaFlow to access or manage data from those platforms.

5. Use of Data & Platform Functionality

MediaFlow processes data to provide:

• Social content scheduling and publishing
• Inbox management for comments and direct messages
• Analytics and performance reporting
• Influencer discovery and campaign management
• AI-assisted caption generation, messaging, and insights

Use of AI features is optional and user-controlled.

6. Data Retention & Deletion

a. Analytics & Platform-Generated Data

Analytics, reports, dashboards, AI-generated insights, campaign summaries, and other platform-generated user data are retained while the user's account remains active, based on the user's subscription tier, unless the user deletes the data or revokes access.

b. Messages & Comments

• Direct Messages: retained for 21, 45, or 90 days (user-selected; default 45 days)
• Comments: retained for 7, 14, or 30 days (user-selected; default 14 days)

c. Revocation & Account Deletion

Upon disconnection of a third-party account, access tokens are revoked immediately, and associated data is deleted within 30 days.

Upon account deletion, all personal data is deleted within 30 days, subject to legal or compliance obligations.

7. AI-Powered Features

MediaFlow may use third-party AI providers (including OpenAI, Google Gemini, and Anthropic) to generate captions, draft replies, analyze performance, or provide insights.

By using AI features, you acknowledge that:

• Content may be processed by AI providers solely to deliver the requested feature
• AI outputs may require human review and judgment
• MediaFlow does not permit AI providers to train public models on identifiable user content

8. User Responsibilities

You agree not to:

• Use the Services for unlawful or fraudulent purposes
• Misuse analytics or misrepresent performance data
• Access data without authorization
• Sell, scrape, or redistribute platform data
• Attempt to reverse engineer or exploit the Services

You are solely responsible for content you publish, schedule, or approve.

9. Intellectual Property

MediaFlow and its underlying software, design, branding, and technology are owned by TrueGrow AI and protected by intellectual property laws.

You retain ownership of content you upload. You grant MediaFlow a limited, non-exclusive license to use such content solely to provide the Services.

10. Payments & Subscriptions

Some features require paid subscriptions. Pricing, billing cycles, and feature availability depend on your selected plan.

Payments are processed through third-party payment processors (e.g., Stripe). Fees are non-refundable unless required by law.

11. Suspension & Termination

We may suspend or terminate access if you:

• Violate these Terms
• Breach applicable laws or platform rules
• Misuse data or integrations
• Pose security or legal risk

You may terminate your account at any time.

12. Disclaimer of Warranties

The Services are provided "as is" and "as available." We make no warranties regarding uninterrupted availability, accuracy, or error-free operation.

13. Limitation of Liability

To the maximum extent permitted by law, TrueGrow AI shall not be liable for indirect, incidental, consequential, or punitive damages.

Our total liability shall not exceed the amount paid by you to TrueGrow AI in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless TrueGrow AI from claims arising out of your use of the Services, violation of these Terms, or misuse of data.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

Disputes shall be resolved through binding arbitration unless prohibited by law.

16. Changes to These Terms

We may update these Terms periodically. Material changes will be communicated via email or in-app notification.

Continued use constitutes acceptance.
